Terms of service

These Terms of Service apply when you access the DIY.CO website, purchase products from us or otherwise use our online services.

Throughout these Terms, “DIY.CO”, “we”, “us” and “our” refer to DIY.CO Limited.

By using our website or placing an order with DIY.CO, you agree to these Terms of Service together with our Privacy Policy, Shipping Policy, Refund & Returns Policy and Warranty & Use Policy.

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies that cannot legally be excluded under New Zealand law.

1. Online Store

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer and sell our products.

You must use our website and products only for lawful purposes.

You must not attempt to interfere with the security, functionality or operation of our website, including by introducing malicious software, attempting unauthorised access or using the website for fraudulent activity.

2. Product Information

We aim to ensure that product descriptions, specifications, pricing, images and other information displayed on our website are accurate and up to date.

From time to time, minor differences may occur between product images and the actual product, including differences in colour or appearance caused by screen settings, photography or product updates.

We may update product specifications, descriptions or imagery where necessary.

Nothing in this section limits any rights you may have where a product does not match its description or otherwise fails to meet requirements under New Zealand consumer law.

3. Product Use

DIY.CO recovery products must be used in accordance with the instructions, warnings and guidance supplied with the product.

It is your responsibility to ensure the product is appropriate for your intended use.

Our products and website content are provided for general wellness, recovery and informational purposes and are not intended to replace individual medical advice, diagnosis or treatment.

If you have a medical condition, injury, are pregnant, have concerns about circulation or are unsure whether a recovery product is suitable for you, we recommend seeking advice from an appropriately qualified healthcare professional before use.

4. Prices

All prices displayed on our website are in New Zealand dollars (NZD) unless otherwise stated.

Prices may change from time to time.

Any applicable shipping, freight or other charges will be displayed or communicated before the order is completed where reasonably practicable.

If an obvious pricing or listing error occurs, we may contact you to correct the issue before fulfilling the order.

Any action we take in relation to an error will remain subject to applicable New Zealand law.

5. Orders

Submitting an order does not necessarily mean that we have accepted it.

We may decline or cancel an order where reasonably necessary, including where:

  • A product is unavailable
  • There has been an obvious pricing or listing error
  • Payment cannot be processed
  • We reasonably suspect fraudulent activity
  • We are unable to deliver to the address provided
  • The order appears to be placed for unauthorised resale

If we cancel an order after payment has been taken, we will refund the applicable amount.

We may contact you using the email address or phone number supplied with your order where clarification is required.

6. Payment

Payment must be made using the payment options available at checkout.

Payments may be processed through Shopify and third-party payment providers such as Afterpay or other providers made available on our website.

Your use of a third-party payment service may also be subject to that provider’s terms and conditions.

7. Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy.

Delivery timeframes shown on our website are estimates unless expressly stated otherwise.

Where DIY.CO arranges delivery to a consumer, any rights you have regarding damaged, delayed or missing products remain subject to applicable New Zealand consumer law.

8. Returns, Refunds and Faulty Products

Returns and refunds are governed by our Refund & Returns Policy.

Products purchased for personal or household use may also be protected by the Consumer Guarantees Act 1993.

Where applicable, these rights exist independently of our store policies or warranty periods.

9. Warranty

DIY.CO products are covered by the applicable warranty set out in our Warranty & Use Policy.

Our stated warranty is additional to any rights or remedies available under applicable New Zealand law.

10. Commercial and Sports Team Use

Products used in gyms, sports teams, clinics, recovery facilities, wellness businesses, rental environments or other commercial/shared-use settings may be subject to different warranty terms.

Please refer to our Warranty & Use Policy for details.

Where products are acquired for business purposes, different legal provisions may apply.

11. Intellectual Property

Unless otherwise stated, content on this website, including our branding, product images, graphics, written content and website materials, is owned by or licensed to DIY.CO.

You may not reproduce, distribute, modify, commercially exploit or use our content without our prior written permission, except where permitted by law.

12. Reviews, Photos and Other Content You Submit

If you submit a review, comment, photograph, video or other content to DIY.CO, you confirm that:

  • The content is yours or you have permission to provide it
  • It does not infringe another person’s rights
  • It is not unlawful, misleading, defamatory or offensive

Where you expressly provide content to DIY.CO for marketing or promotional use, you grant us permission to use that content for the purposes agreed with you.

We will not treat unsolicited private communications as marketing content without appropriate permission.

13. Third-Party Services and Links

Our website may include links to or integrations with third-party services.

DIY.CO does not control third-party websites and is not responsible for their independent content, privacy practices or terms.

Your use of third-party services may be subject to the relevant provider’s own terms.

14. Privacy

Our collection, use and disclosure of personal information is governed by our Privacy Policy and the New Zealand Privacy Act 2020.

15. Website Availability

We aim to keep our website available and functioning correctly but do not guarantee uninterrupted or error-free access.

We may update, maintain, suspend or change parts of the website where reasonably necessary.

16. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

To the maximum extent permitted by law, DIY.CO will not be responsible for losses arising from:

  • Use of a product contrary to supplied instructions
  • Unauthorised modification or repair
  • Damage caused by misuse or improper storage
  • Events outside our reasonable control

Where the Consumer Guarantees Act 1993 or other mandatory consumer protections apply, your rights under those laws are not affected by this section.

17. Prohibited Use

You must not use our website:

  • For unlawful or fraudulent purposes
  • To infringe intellectual property or privacy rights
  • To distribute malware or harmful code
  • To interfere with website security or operation
  • To scrape, harvest or collect information unlawfully
  • To impersonate another person
  • To submit false or misleading information

We may restrict access to the website where we reasonably believe these Terms have been breached.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, policies or legal requirements.

The most current version will be published on our website.

Any changes will apply from the date the updated Terms are published and will not remove rights already accrued under applicable law.

19. Governing Law

These Terms are governed by the laws of New Zealand.

Nothing in these Terms prevents a consumer from exercising any rights available under New Zealand law.
